Shipping to Texas: What Texas Hemp Law Allows

Hempire Innovations no longer ships THC products to Texas

Texas has put a series of hemp restrictions in place since 2025. Because of these Texas laws, Hempire Innovations no longer ships THCa flower, THCa prerolls, Delta 8, THC-P or THC vapes to Texas addresses. Here is which Texas law affects which products, and the date each one started.

Texas hemp laws and their effective dates

  • THC vapes, September 1, 2025: Texas Senate Bill 2024 (Health and Safety Code Section 161.0876) makes it a Class A misdemeanor to market or sell any vape that contains cannabinoids.
  • THCa flower and prerolls, March 31, 2026: Texas Department of State Health Services rules (25 TAC Chapter 300) now count THCa toward the 0.3% THC limit. Natural THCa flower does not pass that test.
  • Delta 8, Delta 10, THC-P and other converted THC, July 31, 2026: after the Texas Supreme Court's May 1, 2026 decision in Texas Department of State Health Services v. Sky Marketing Corp., the department began enforcing its Schedule I definitions. Every form of THC other than Delta 9 is now a Schedule I controlled substance in Texas, and possession can be charged as a state jail felony.
  • Delta 9 THC: Texas Health and Safety Code Chapter 443 still allows hemp products with no more than 0.3% Delta 9 THC by dry weight. We are not shipping Delta 9 products to Texas at this time.
  • CBD: compliant CBD products are not affected by these Texas laws.
